Do I need release of liability waiver if tenant works for me?

One of my tenants does minor work for me such as cleaning snow, grass, clean hallways etc.

If he injures himself I think he might sue me or his family. If yes,

How is he doing this work - as an employee or as a contractor?

Either way, a claim of injury will fall under your workers comp insurance. If he is working as a contractor you can require him to obtain workers comp, but if he doesn't have it then it will fall on yours.

At any rate, you aren't going to be able to get him to sign a release that will hold up in court, but it might have some prophylactic value. The best way to protect yourself is to hire him as a contractor and have him provide his own workers comp. Get a copy of the certificate from him.
